General Information

This present Website Application constitutes the property of MikNik, which operates from Andrea Onisiforou 29, Aradippou, Larnaca, Cyprus, 7101. By accessing or using MikNik and its services, each visitor, supplier, advertiser or member user (collectively referred to as "Users") unreservedly agrees to comply with these Terms of Use, which apply to all content, images, and files within the MikNik web application (henceforth referred to as "Terms of Use").

Consequently, it is strongly recommended that visitors, suppliers, advertisers or member users read these Terms of Use thoroughly before using MikNik's services. If a visitor, agent, or user does not consent to these Terms of Use, they should refrain from using the services and content of the MikNik web application.

MikNik declares that all expected precautions and measures are taken to provide complete, accurate, and reliable information on its web application.

Acceptance of Terms

By utilizing the services provided by MikNik, Users acknowledge that they have read, understood, and agree to be bound by these Terms of Use. If Users do not agree with any part of these Terms, they are advised not to use the services offered by MikNik. MikNik reserves the right to modify these Terms at any time, and continued use of the services signifies acceptance of any revised terms. Users will be notified of significant changes via email.

Intellectual Property

All content on the MikNik website and application, including text, images, and software, is the intellectual property of MikNik and is protected by all relevant laws and provisions of Cypriot and European law, as well as international conventions concerning trademarks and industrial and intellectual property.

The display of this content on the MikNik web application must not be considered, under any circumstances, as a transfer or assignment of any license or right to use, reproduce, or distribute it, other than the right to view it online for personal use.

Any reproduction, copying, republishing, uploading, posting, distribution, or broadcasting of the content of the MikNik web application for commercial or any other purposes is allowed solely with prior written permission from MikNik or another authorized holder of the intellectual property rights.

The MikNik web application may include links to third-party websites or services for the convenience of Users. MikNik does not bear responsibility for their content, functionality, or accuracy. By using such third-party services, Users agree to the terms and policies applicable to those services.

User Definitions

1. Member User: A user who has paid a subscription fee to access discounts offered by MikNik.
2. Supplier User: A designated user who has account access to verify the validity of Member Users and authorize discounts.
3. Advertiser User: A user who promotes MikNik using a specific QR code generated by MikNik and earns a commission for each subscription from clients they bring to the website.

Registration Requirements

Users must meet the following requirements to be considered as Member Users, Suppliers, or Advertisers Users of the MikNik web application:

Age: Users must possess a valid credit or debit card issued in their name. They can buy a subscription for another member of their family who is not old enough to possess a credit or debit card.

Information Required: During the registration process, Users must provide their name, phone number, and email address. This information will be collected to create a username and password, as well as to track where discounts are used and improve MikNik's services in the future.

Agreement to Terms: Users must agree to these Terms of Use as a condition of registration.

Services Provided

MikNik offers a subscription-based service that allows Member Users to access various discounts throughout Cyprus. Users are required to pay an initial subscription fee for a 30-day period to gain access to the discounts provided.

In the event that the services offered by MikNik do not meet the advertised offerings, Member Users have the right to request a refund within 24 hours of subscription. Refund requests must be made through the specified process communicated during subscription.

Payment and Refund Terms

All Member Users are required to pay a subscription fee to access the discounts offered through MikNik. Payment will be processed through a third-party payment provider, JCC (https://www.jccsmart.com/). MikNik does not store sensitive payment data.

Each Member User will receive a unique QR code upon successful subscription, which can only be used by them. For Advertise Users, a unique QR code will be generated to promote MikNik. If individuals subscribe through the Advertise User's QR code, the Advertise User will earn a commission as agreed in their contract at the end of each month. MikNik will provide a statement detailing the number of clients subscribed through each Advertise User.

To request a refund, Member Users can send an email to MikNik – miknikdiscount@gmail.com using the "Contact Us" button in the sidebar of the website. Upon requesting a refund, Member Users will lose access to the respective discount services. Refunds will be processed within 5 business days.

User Responsibilities

Users agree to use the MikNik services solely for lawful purposes and in a manner that does not restrict or hinder access to other users. Users are obliged to comply with all applicable laws and regulations and to act in good faith at all times while using the MikNik web application.

Users must ensure that all information provided during registration is true, accurate, and complete. MikNik reserves the right to deny or revoke access if any information is found to be false, inaccurate, or incomplete.

If MikNik notices that the same QR code is being used in multiple locations simultaneously, which is not physically possible, MikNik reserves the right to terminate or ban the user's account.

Limitation of Liability

MikNik makes every effort to ensure that the content and information on the web application are accurate, clear, and complete. However, MikNik does not guarantee uninterrupted access to the web application, nor does it warrant that the services, options, and content will be provided without interruption or errors.

MikNik is not liable for any form of damage incurred by Users from the use of the MikNik web application, including any reliance on the content, services, or options accessed. Users access the web application at their own risk, with full knowledge of an agreement to these Terms of Use.

Indemnification

Users agree to indemnify and hold MikNik, along with its affiliates, officers, directors, employees, agents, legal representatives, licensors, and suppliers, harmless from any claims or demands, including reasonable attorneys' fees, made by any third party due to or arising from a breach of these Terms of Use or a violation of any law or rights of a third party.

Force Majeure

MikNik shall not be held liable for any failure to perform its obligations where such failure is a result of events beyond its reasonable control, including natural disasters, war, civil disturbance, or other causes beyond its reasonable control. During such instances, obligations under the Terms may be suspended until resolution.

GDPR Compliance

MikNik is committed to respecting and protecting the personal data and privacy of each User of the web application. This policy outlines MikNik's commitment to data protection, including the types of data collected, the manner of data processing, and the actions that Users can take regarding their personal information when using the web application.

MikNik will post the latest applicable version of this policy on the web application without prior notification to keep Users fully informed. The management and protection of Users' personal data are governed by the relevant provisions of Cypriot law for the protection of personal data, and in compliance with the European Regulation (EU) 2016/679 issued by the European Parliament and Council.

1. COLLECTION OF DATA

Users can access the Website without providing any of their Personal Data. For access to certain services of the Website, registration may be required. During this process, MikNik may collect only the necessary Personal Data required to fulfill the purposes and functions of the Website, as outlined in this Policy.

2. USE OF PERSONAL DATA

MikNik may collect and process Personal Data of the User through the Website. The collection and processing of Personal Data will be conducted with the Users' explicit consent, solely to enable access to features and services available on the Website.

Personal Data collected by MikNik will be used exclusively to ensure the functionality of the Website services. No additional processing, sharing or exchange of this data will occur. MikNik acts in compliance with the applicable data protection laws and is committed to best practices data security on the Internet.

Personal Data will be securely stored by MikNik, for the duration of the Users' subscription to any of the MikNik's services or as required to achieve the intended purpose. Data will be deleted upon termination of the business relationship between the User and MikNik, in accordance with applicable legal retention periods.

The recipients of Personal Data may include MikNik, affiliated legal entities, or external partners of MikNik, who facilitate the forwarding, support and management of the business relationship, subject to compliance with relevant legal requirements.

3. REVOKING CONSENT

In case a User wishes to withdraw consent for data processing or objects to the processing of their Personal Data, MikNik will comply with their request in line with its legal obligations, as set out by the relevant Law, provided that the instructions are submitted in written form.

For purposes of enactment of their rights, any User may contact MikNik and submit their request in writing via e-mail at miknikdiscount@gmail.com, addressing MikNik's Data Protection Officer.

Amendments to Terms

MikNik reserves the right to amend, modify, or unilaterally update these Terms of Use, along with any related conditions, at any time without prior notice. The latest version of the Terms of Use will be made available on the MikNik web application for the information of Users, and significant changes will be communicated via email.

Governing Law and Dispute Resolution

These Terms of Use, along with any amendments, modifications, or alterations, are governed by and interpreted in accordance with Cypriot law. In the event of any dispute or claim related to these Terms of Use, both parties agree to attempt mediation as the first course of action. If unresolved, the dispute will be referred to binding arbitration in accordance with local laws.

Miscellaneous

If any provision within these Terms of Use is found to be contrary to applicable law, that provision shall cease to be effective without affecting the validity or enforceability of the remaining terms. These Terms of Use constitute the overall agreement between MikNik and Users of the web application and its services.
